Studio Ohana Stone · Dénia, Spain
Terms and Conditions
Last updated: 5 November 2026
These terms explain how Studio Ohana Stone quotes, makes, sells and delivers handcrafted furniture. Your written quotation and order confirmation set out the specifications and price for your particular piece.
1. Who we are and when these terms apply
Studio Ohana Stone is the trading name used by Davey Steenbergen, a self-employed trader (autónomo) established in Dénia, Spain. Registered business address: Carrer de la Pansa 204, 03700 Denia. Spanish tax identification number (NIF/NIE): Z3531682Z. Email: info@ohanastone.nl. Telephone: +31 6 4882 7571. Website: studio-ohanastone.com.
These Terms & Conditions apply to enquiries, quotations and purchases of furniture and related products from Studio Ohana Stone.
If you buy as a consumer, mandatory consumer rights under Spanish and EU law continue to apply.
A business customer is responsible for telling us that the order is for business use before accepting a quotation.
2. Products and handmade finishes
Our furniture is designed and made by hand, often to dimensions, colours, textures or other specifications agreed with the customer. Product descriptions, drawings, samples and photographs are intended to show the design and finish.
Natural variation in hand-shaped forms, microcement texture and colour is expected. We will identify material variations that are likely to affect the agreed appearance before the order is confirmed.
A variation is not acceptable if it means the product materially differs from the agreed specifications, description or sample.
Please review dimensions, intended use, access routes and finish details in the written quotation before approving it.
3. Enquiries, quotations and order acceptance
Product pages may show a guide or starting price. The final price depends on the agreed product, dimensions, finish, quantity, delivery and installation requirements.
We will provide a written quotation describing the product, specifications, price, applicable taxes, delivery or installation charges and estimated production and delivery timing.
An order is accepted when you approve the written quotation and we confirm the order in writing. The order confirmation and quotation form part of the contract.
We will not begin production until the agreed deposit has cleared and the final specifications have been approved in writing.
If the contract is concluded online, we will send confirmation on a durable medium such as email.
Before accepting, please check the spelling, measurements, colour references, finish, access details and delivery address. Changes requested after approval may affect the price and timing and must be agreed in writing.
4. Prices, taxes and payment
Prices are stated in euros. The quotation will say whether VAT (IVA) is included or will be added, and will show any delivery, installation or other charges before you commit.
No undisclosed payment will be added after order acceptance.
Unless the quotation states otherwise, payment is due in the instalments and by the methods listed in that quotation.
A deposit is credited against the purchase price; it is not automatically forfeited if an order is cancelled.
If you ask to cancel a bespoke order after work has begun, we may charge only for work performed and materials or other costs reasonably and demonstrably incurred up to cancellation, subject to applicable law. Any balance will be refunded.
5. Production, delivery and installation
Production and delivery dates are estimates unless the quotation expressly states a binding date. We will tell you about a material delay and agree a revised date or any remedy required by law.
Delivery, carrying into the property, assembly and installation are included only when expressly stated in the quotation.
You must provide accurate delivery details and ensure safe, reasonable access for the agreed delivery. Tell us in advance about stairs, narrow doorways, lifts, parking restrictions or other access limits. We will agree any additional charge before arranging the affected service.
For consumer orders, risk of loss or damage passes to you when you, or a person you nominate (other than the carrier), physically receive the goods. If you independently appoint a carrier that we did not offer, risk may pass when the goods are handed to that carrier, as permitted by law.
Please inspect the delivery and contact us promptly about visible damage; this request does not limit your legal rights.
6. Bespoke orders, cancellation and statutory withdrawal
Many pieces are made to the individual customer’s specifications or are clearly personalised. The statutory 14-day right of withdrawal does not apply to a product that meets this legal definition.
We will identify the relevant product and specifications before you commit and obtain your express acknowledgement where the order flow requires it.
Being handmade or made after an order is placed does not, by itself, remove the right of withdrawal.
If a product is a standard, non-personalised item and the statutory withdrawal right applies, the separate Refund & Withdrawal Policy explains how to use it.
No withdrawal exception affects your legal rights if a product is faulty, damaged or does not conform to the contract.
For cancellation of a bespoke order outside a statutory withdrawal right, contact us as soon as possible. Any amount retained will be limited to reasonable, evidenced work and costs already incurred, and is subject to mandatory consumer law.
7. Legal conformity and complaints
Consumer goods must conform to the contract. Under Spanish law, the seller is generally responsible for a lack of conformity that becomes apparent within three years of delivery of new goods. This legal protection is separate from any commercial warranty and is not reduced by these terms.
The remedies available may include repair or replacement and, where the legal conditions are met, a price reduction or termination of the contract.
To raise a concern, email info@ohanastone.nl with your order details, a description of the issue and photographs where helpful. We will respond and arrange an appropriate solution under applicable law.
Handmade character, normal wear, misuse, accidental damage or failure to follow care instructions may be relevant to whether a problem is a lack of conformity; they do not automatically exclude a valid legal claim.
8. Website content and intellectual property
Unless stated otherwise, the text, photographs, designs and other content on the website belong to Studio Ohana Stone or are used with permission. You may not reproduce or commercially use them without prior written permission.
Product concepts, drawings or samples prepared for a custom project remain ours unless the quotation expressly says otherwise.
9. Privacy, website use and cookies
Personal data are handled as described in our Privacy Policy.
Non-essential cookies or similar technologies are used only in accordance with the cookie settings and applicable consent rules.
Please use the website lawfully and do not interfere with its security or operation.
10. Governing law and consumer dispute rights
These terms are governed by Spanish law, without removing protections that mandatory consumer law gives you.
If you are a consumer resident in another country, you may also benefit from mandatory protections in your country of residence where applicable.
You may bring a claim before the courts that have jurisdiction under applicable consumer law.
If you have a complaint, please contact us first at info@ohanastone.nl so we can try to resolve it. You may also use available consumer complaint channels in your place of residence.
The former EU Online Dispute Resolution platform was discontinued on 20 July 2025; we do not direct customers to that platform.
11. Contact and changes
